The Bendix® “The Passion That Drives You®” Scholarship Contest (the “Contest”) is intended for viewing and participation only within the 50 United States and the District of Columbia and shall be governed solely by U.S. law.  Do not proceed in the Contest site if you are not a legal resident of the 50 United States or the District of Columbia at the time of entry. Contest begins at approximately 12:01 a.m. Eastern Time (“ET”) on October 4, 2010 and ends at 11:59:59 p.m. ET on November 30, 2010 (“Contest Period”). Sponsor’s computer shall be the official clock of the Contest. Participation in the Contest constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor and Judges, which are final and binding.

ELIGIBILITY: The Contest is open only to legal residents of the 50 United States, and the District of Columbia who are at least 18 years of age, or the age of majority in their state of residence at the time of entry. Winner must be enrolled in the field of automotive technology/repair at an accredited U.S. Career Technical school, institute, college or university or planning to enroll within 90 days of the contest’s ending date. Employees, officers and directors, their immediate family members (spouse, siblings, children and parents, regardless of where they live) or members of the same households (whether related or not) of Friction Materials, LLC (the “Sponsor”), its parent, affiliates, subsidiaries, printers, advertising, PR and promotion agencies and any and all companies associated with the development, distribution or implementation of this Contest are not eligible. The Contest is subject to federal, state, and local laws and regulations and is void where prohibited by law.

HOW TO ENTER: During the Contest Period, visit www.bendixpassion.com (“Contest Web Site”) and accurately complete the registration form with your full name, address, city, state, ZIP code, date of birth, daytime phone number and e-mail address. In text format, submit a written essay that answers the question: “Why are you passionate about entering the field of automotive technology and how will going to school help you achieve your dreams?”.  Written entry must be completed and must fall within the word limit as stated on the Contest Web Site in order for your entry to be considered for submission into the Contest. Entrants must also submit an Image File (.jpg, .gif or .png only; Quantity limit: 1; Size limit: 2 MB). Only the file types, quantity and size limits as described above will be allowed (a qualified entry with a written portion and an Image File that meet the qualifications and rules of this Contest shall be referred to as an “Entry”).

All entries submitted must be the original creation of the entrant, must be in English, and cannot have been previously published in any medium or submitted in any other competition or contest. Entries deemed by Sponsor in its discretion to be obscene or that otherwise contain Offensive Content, as defined below, will be disqualified. 

Limit one (1) entry per person per email address during the Contest Period. All entries must be received by 11:59:59 p.m. ET November 30, 2010. Group or joint entries will not be accepted; a single individual must be identified as the entrant for an entry. Any attempt by any entrant to submit more than one (1) entry using multiple/different identities or any other methods will void such entries, and that entrant may be disqualified. 

Any information collected on the Contest Web Site shall be used only in a manner consistent with the consent given by entrants at the time of entry, these Official Rules, and the Honeywell International Inc. Privacy Policy, which can be found at http://www51.honeywell.com/privacy/en.html.

CONDITIONS OF ENTRY: By submitting an entry during the Contest Period, each entrant agrees to fully comply with the Official Rules and the decisions of the Sponsor and all Judges. Each entrant represents, warrants and agrees that: (a) his/her entry is the original work of the entrant and has not been copied in whole or in part from any other work; (b) his/her entry has not previously been published in any medium or submitted to any other competition or contest; (c) his/her entry does not infringe or violate the rights of any third party, including, but not limited to, copyrights, trademarks, patents, trade secrets, logos, contract and licensing rights, rights of publicity or privacy, moral rights or any other intellectual property rights; (d) the entry does not contain any copyrighted material not owned by entrant or used without permission (including, without limitation, company names, music, photographs, works of art, images published on or in websites, television, movies or other media) and, to the extent necessary to avoid any such infringement, the entrant has obtained all necessary approvals, licenses, permits, rights, assignments, waivers, consents and permissions to all underlying elements, use of non-public figures names in whole or in part (including, without limitation, entrant’s last name) or other works or properties incorporated  into the entry and entrant will be able to furnish satisfactory (as determined by Sponsor in Sponsor’s sole discretion) proof of such approvals, licenses, rights, assignments, waivers, consents and permissions to Sponsor upon request; (e) his/her entry is not subject to any third party agreements and the Sponsor will not be required to pay or incur any sums to any person or entity as a result of its use or exploitation of the entry or ideas contained therein; (f) his/her entry contains no defamatory, profane, threatening, hateful, pornographic, lewd, obscene, harassing, or otherwise unlawful material, any commercial material, or any material that promotes alcohol, illegal drugs, tobacco, firearms or other weapons, is slanderous, libelous, racist, offensive or otherwise derogatory of any ethnic, religious or other group or promotes violence or harm to another living creature, does not contain any content that is likely to be considered offensive by Sponsor or could adversely affect the name, reputation or goodwill of the Sponsor, or any other content deemed inappropriate by Sponsor, in its sole discretion (collectively, “Offensive Content”); and (f) no laws were broken in the creation of the entry. 

Entrant further represents and warrants that each and every person depicted in, heard in, or otherwise recognizable in or associated with the entry, including, without limitation, all models, photographers, artists, copy writers, performers, producers and directors (“Involved Third Party”), whether they are actually depicted in the entry, or whether their appearance, or creative contributions are expressed by, recognizable in, or incorporated into the entry, will execute a Publicity Waiver and Release, if requested by Sponsor and except where prohibited by law (if such individual is a minor in his/her jurisdiction of residence, the Publicity Waiver and Release will be executed by his/her parent or legal guardian) and that each of the signatures will be submitted as required by the Official Rules. Entrants agree to indemnify, defend and hold Sponsor harmless from and against any and all liabilities, losses, damages, claims, debts, investigations, fines, penalties, costs, expenses and settlements (including attorneys’ fees and costs of litigation, settlement, judgment, interest and penalties) arising out of or related to their entry or participation in the Contest, receipt of prize(s) and/or breach of representations and warranties. 

For entries posted on the Contest Web Site, entrants acknowledge and agree that: (a) while the Sponsor will seek to accurately present these entries on the Contest Web Site, the entries as posted on the Contest Web Site may differ from the entries as originally submitted by entrants due to technological malfunction, error, defect, limitation and/or modifications and the Sponsor and its agencies shall have no liability related thereto; (b) the Sponsor may append comments/commentary of their sole choosing, to one or more entries in its sole and absolute discretion; and (c) entrant hereby releases and discharges the Releasees (as defined below) from all liability resulting from any distortion, alteration, or faulty reproduction which may occur in the dissemination or use of any entry. 

Sponsor reserves the right to reject any entry and disqualify any entrant which, in its sole and absolute discretion, is determined not to meet any of the conditions set forth in these Rules. If Sponsor rejects any entry, in its sole and absolute discretion, such entry will not appear on the Website and will not be considered a valid entry in the Contest.  No correspondence will be entered into with regard to such disqualified entries. WITHOUT LIMITING THE GENERALITY OF THE REPRESENTATIONS AND WARRANTIES LISTED ABOVE, BY ENTERING THE CONTEST ENTRANT REPRESENTS AND WARRANTS THAT HE OR SHE HAS OBTAINED ALL OF THE RIGHTS, LICENSES AND PERMISSIONS FROM EACH PERSON WHO APPEARED IN OR HELPED TO CREATE THE ENTRY. If the Sponsor determines, in its sole discretion, that an entrant has breached a representation or warranty, the entrant will be disqualified.

JUDGING CRITERIA/SELECTION OF FIRST PRIZE WINNERS:  At the Contest conclusion, a panel of qualified, independent judges determined by Sponsor in its sole discretion will select the eight (8) entrants based on the highest scoring written entry (the potential “First Prize Winners”), subject to the potential Winners compliance with these Official Rules, from among all eligible Submissions based on the following criteria:

  • Originality of Submission - 500 Points
  • Creativity - 300 Points
  • Fit to Contest Theme - 200 Points

In the event of a tie, the entrant whose Submission received the highest score in the Originality of Submission category, as determined by the qualified judges in their sole discretion, will be deemed the applicable potential First Prize Winner.  Sponsor reserves the right to select fewer than eight (8) potential Winners, if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Submissions.

JUDGING CRITERIA/SELECTION OF GRAND PRIZE WINNER: The Grand Prize judging will take place in two parts.
1) Grand Prize Panel: The Entries of the 8 First Prize winners will be judged by a panel of qualified, independent Grand Prize judges (the “Panel”) selected by the Sponsor based on the ability of the Entrant to “demonstrate why they are passionate about entering the field of automotive technology/mechanics” – worth 100 points possible; and,
2) Voting: The entries of the First Prize winners and all eligible entries will be posted on the Contest Web Site, www.bendixpassion.com where they may be voted on by the public. Public voting will begin at 12:01 a.m. ET October 4, 2010 and run through 11:59 p.m. ET December 15, 2010. Public may vote all on posted entries, however, public voting will only count towards the selection of the Grand Prize Winner from the (8) potential First Prize Winners. The First Prize Winners’ entries will be awarded points for the voting as outlined below:

The potential First Prize Winner’s entry with the highest number of points as determined by the Grand Prize Panel and the Voting will also win the Grand Prize. In the event of a tie, all tied First Prize Entries will be scored again based on quality production values – worth 100 points. The tied First Prize Entries that has the highest score will be determined the Grand Prize winner.

Any votes created by macro, programmed, robotic or other methods will be removed, and any entrant Sponsor suspects of using such methods, directly or indirectly will be disqualified. Limit one (1) vote per person, per e-mail address. In the event of a delay in confirmation of the finalists, Sponsor reserves the right to change the times and/or dates for voting online and such revised times/dates will be posted on the Contest Web Site. Limit one entry/online vote per person and limit one entry/online vote per e-mail address. Entrant may not use any device or artifice to enter/vote multiple times or as multiple entrant. Any attempt by an entrant to obtain more than the stated number of votes/entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that person’s votes/entries and that entrant may be disqualified.

PRIZES:  
One (1) Grand Prize:  A four (4)-day, three (3)-night trip for two (2) to an NHRA (National Hot Rod Association) race. Race date and location to be determined by the Sponsor. Trip for the Grand Prize winner and one (1) guest includes round-trip coach (economy)-class air transportation (flight carrier to be selected by Sponsor) for two (2) from a major commercial airport in the U.S. closest to winner’s residence (selected by Sponsor) and three (3) nights standard hotel accommodations (double occupancy, includes room and tax) at the hotel close to the NHRA race track, selected by Sponsor, and ground transfers to/from the airport and hotel and $400 in spending money  for winner only (awarded via check to the Grand Prize Winner). Trip includes: two (2) NHRA race tickets for three (3) race days; and two (2) VIP passes for three (3) race days. Total Approximate Retail Value (“ARV”): $3,000. Actual value depends on date/time/point of departure, and any difference between the stated ARV and actual value will not be awarded. Grand Prize Winner and Guests are solely responsible for checked baggage fees, food and beverage, gratuities, other incidental hotel expenses and other expenses not listed in these Official Rules. Grand Prize Winner and Guest must travel from one departure location and must travel on the same itinerary and all travel arrangements must be made with Sponsor or Sponsor’s agent at least 21-days in advance of travel. Travel subject to availability and must be completed on dates approved by Sponsor or prize will be forfeited. Some restrictions and blackout dates may apply. Travel must be completed within 12 months of winner verification. No cancellation of reservation or transfer of reservation to another date after reservation had been made. If Grand Prize Winner’s Guest is a minor in his/her jurisdiction of residence, he/she must be accompanied by his/her parent or legal guardian. If Grand Prize Winner resides within a 100-mile radius of the destination, ground transportation may be provided in lieu of air transportation and no compensation or substitution will be provided for any difference in prize value. 

Eight (8) First Prize Winners:  A $2,500 scholarship redeemable at an accredited U.S. Career Technical school, institute, college or university as defined as an institution whose primary function is the presentation of formal instruction and normally maintains a regular faculty and curriculum and normally has a regularly enrolled body of students in attendance at the place where its education activities are carried on. Approximate Retail Value (“ARV”): $2,500.  Winner must be enrolled in such a school or university or planning to enroll within 90 days of the contest’s ending date and winner must provide Sponsor with his/her school account/contact details in order to receive the prize. The scholarship cannot be used for other purposes, such as room and board, or course-related expenses, such as fees, books, supplies, and equipment. Winners are responsible for all federal, state and local taxes and any other costs, expenses or fees associated with prize acceptance and/or use not specified herein as being provided. All prize details are at Sponsor’s sole discretion.

Total Approximate Retail Value (“ARV”) of all available prizes: $23,000

TERMS AND CONDITIONS APPLICABLE TO PRIZES: All prizes will be awarded provided a sufficient number of eligible entries are received, but in no event will Sponsor award more prizes than are provided for in these Official Rules. Prize details and availability are subject to change, in which case, unless otherwise specified herein, a prize of equal or greater value will be substituted at Sponsor’s sole discretion. In the event that the NHRA race is cancelled, Sponsor reserves the right to award the trip without the race. Prizes are non-transferable except at Sponsor’s sole discretion. No substitutions or cash redemptions except at the sole discretion of the Sponsor and as described above. All federal, state and local taxes, as well as any and all travel insurance and any other unspecified expenses associated with acceptance or use of prize, including without limitation, all meals, non-airport ground transportation, and gratuities are the responsibility of the winners. Limit one (1) prize per person, per household.

CLAIMING PRIZES:  Sponsor will attempt to notify potential winners by phone and/or overnight mail on or about January 14, 2011. Awarding of prizes is subject to verification of entry, and compliance with these Official Rules. Potential prize winners will be required to execute and return an Affidavit of Eligibility, Release of Liability and (except where prohibited by law) Publicity Release (collectively, “Release Forms”) within seven (7) business days of receipt, per Sponsor’s directions. Tennessee residents need not submit Publicity Release.  In the event of non-compliance with Official Rules, if a potential winner or entry is deemed ineligible, declines prize or fails to return Release Forms within the time period specified by the Sponsor, or Release Forms or prize is returned as undeliverable, prize will be forfeited and awarded to the entrant with the next highest score. 

By participation in the Contest, all participants acknowledge compliance with and agree to be bound by these Official Rules, the decisions of Sponsor and/or Judges, which are final in all respects, and all federal, state and local laws and regulations.    

CONDITIONS: The copies of all entries submitted to Sponsor become the property of the Sponsor and entrants retain any and all copyrights in their entries. By submitting an entry, each entrant grants to Sponsor, its affiliated companies and their agents, successors, and assigns, and anyone authorized by them,  a non-exclusive, perpetual, irrevocable, worldwide, royalty-free right and license to use, copy, reproduce, display, perform, distribute, modify, adapt, sell, publish and/or use create derivative works based on, or not use, the entry in any way, for any purpose and in any media whatsoever, whether or not now known, throughout the universe in perpetuity, without further compensation to entrant. Submitted entries will not be acknowledged or returned. Any entry not in compliance with these Official Rules will void the entry and disqualify the entrant. Sponsor reserves the right to disqualify any person found or suspected of tampering with the entry process or the operation of this Contest, to be acting in violation of these Official Rules, to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. In the event of dispute as to who submitted an entry, the entry will be deemed submitted by the Authorized Account Holder of the e-mail address submitted at the time of entry. “Authorized Account Holder” is defined as the natural person assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the e-mail address in question. If, for any reason, the Contest is not capable of running as planned by reason of, but not limited to, tampering, unauthorized intervention, fraud, technical failures or any other causes which Sponsor deems could corrupt or affect the administration, security, fairness or proper conduct of this Contest, Sponsor reserves the right at its sole discretion to cancel, modify, suspend or terminate the Contest and select the winners from among all eligible entries received prior to the action, or as otherwise may be deemed fair and equitable by Sponsor. Sponsor shall post notice of such action at www.bendixpassion.com.

Any attempt by an entrant to deliberately damage the Contest Web Site or undermine the legitimate operation of this Contest is a violation of Criminal and Civil Laws. Should such an attempt be made, Sponsor reserves the right to seek damages from any such individual to the fullest extent permitted by applicable law.

LIMITATIONS OF LIABILITY: By participating in this Contest entrants agree to release and hold harmless Sponsor, its respective affiliated companies, subsidiaries, printers, advertising and promotion agencies and each of their respective employees, officers, directors, representatives and agents (collectively, the “Releasees”) from any and all liability for any injuries, losses or damages of any kind to persons, including death, or property arising in whole or in part, directly or indirectly, from acceptance, use or misuse of a prize, participation, or inability to participate in Contest, any entries or any Contest-related activity. Releasees are not responsible for printing errors or for lost, late, unintelligible, misdirected, incomplete, damaged or garbled entries, the Release Forms, or any other documents. Releasees are not responsible for any: (a) telephone, computer, hardware, software, programming or interrupted or unavailable network, server or other connections, network malfunction, or other technical failures or errors, or failure to properly process entries; (b) communication disruption or other forces beyond the reasonable control of the Sponsor, including inability to access the Contest Web Site, submit entries or other disruption related to Internet traffic, virus, bug, or non-authorized intervention; (c) damage caused by computer virus or otherwise resulting to any computer from entrant's access of the Contest Web Site, whether human, mechanical or electronic; or (d) incorrect or inaccurate information whether caused by Contest Web Site users or by any of the programming or equipment associated with or used in the Contest. Releasees shall not be liable to any winner or any other person for damage to such person’s computer or its contents. Proof of submitting information at Contest Web Site is not considered proof of delivery or receipt.

Releasees shall not be liable to any winner or any other person for failure to supply a prize or any part thereof, by reason of: any acts of God; any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entities (whether or not they prove to be valid); equipment failure; terrorist acts; earthquake; fire; flood; war; explosion; unusually severe weather; hurricane; embargo; labor dispute or strike (whether legal or illegal); labor or material shortage; transportation interruption of any kind; work slow-down; civil disturbance; insurrection; riot; or any other cause beyond Sponsor’s sole control.
